I just got throught and they told me I am out of benefits and didn't qualify for EB because I didn't work 20 weeks in 2009. Does that make sense? So I am ---- out of luck.

NO u need to call back and speak to someone else, because EB has NOTHING TO DO with working 20 weeks!

MY ONLY CONCERN IS (maybe someone can help me) when I first filed my claim it was denied (because my old boss fought it and lied) BUT at the hearing they sided with me
does that count as a disqualification??? even though I WON the hearing?

I wouldn't think so.

The lady I need to talk to.. well.. her VM is full. I give up. I emailed them. I'm not going to keep waking up at 4:30am just so I can call and TRY to get to her instead of a VM. I'll remember that when they do decide to pay me. I'll charge interest. Just like they would.

OK Well I just got off the phone with Remote Services, Lady was nice and helpful BUT still a mess!

OK She had to MANUALLY move me into EB
which she did
HOWEVER she told me that at this point they WILL be taking 50% out every week for 12 -13 weeks or so until the overpayment balance is paid off!!!!!!

she said to request the WAIVER any way,even though its a long shot. BUT at this point they wont be moving those weeks up / swapping them out b/c of the way the program is set up!
so HOW in the hell can i live on $110 a week for 3 months?????

I bet the reason is because they can't just take weeks away from you. How would they know if you were still meeting the requirements to collect? Look at this way.. at least you are getting something. Negotiate with them.. when you file the waiver put in you'd like 25 percent of it taken a week instead of 50, since it's their fault, you shouldn't have to suffer.

well i sent the waiver request, but dont know how much negotiating room there is, i mean u dont talk to a person, u send a request and get a letter in the mail
AND i dont know if the EB will go through or not
she SAID she opened it but who knows the outcome

WELL at this point all i can think to do, is wait until the EB kicks in and call back and see if someone can manually move those weeks up instead of taking 50% away...
