Yes.
Oh I meant the NYPD. Is the NYPD liable for shooting an armed man who posed a threat to others?

Exactly only three of the 9 were hit with whole bullets the rest by fragments. So are the cops now supposed to figure which way projectiles from their bullets are supposed to go?

“We recovered whole bullets from two of the victims, Mr. Kelly said at an event in Harlem. “Actually, we think a total of the three out of the nine bystanders were struck with bullets, the rest were struck with fragments of some sort.”

Mr. Kelly’s comments reinforce the picture that began to emerge on Friday: that in acting quickly and with deadly force, the police prevented the gunman, Jeffrey T. Johnson, 58, from inflicting more harm but in so doing also were responsible for many of the injuries.

The police shot and killed Mr. Johnson shortly after he had killed a former colleague.

Three of the victims from Friday’s shooting were still in the hospital on Saturday, two at Bellevue Hospital Center, the other at NewYork-Presbyterian/Weill Cornell hospital.

A 25% success rate = F.

And yes, one must gauge fragments. I went to college in NYC. That area is packed to the gills, and smart cops use tremendous restraint in such situations.

Cops who use restraint when someone points a gun at them are dead cops. As I noted earlier also, we have no idea, those bullets might have been direct hits that passed through the guy.

What we do know is the story was innaccurate.. It was NOT a mass shooting by a gunman. He shot and killed 1. It was a mass shooting by the NYPD.

Well probably not, but one of the main rules of firing a gun is "be absolutely certain you know what you're shooting at, and that you bullet will not injure anyone beyond your target".

So, that being said, of course the cops were going crazy with this nut case on the loose, but I fail to see even in that case how firing with disregard of the aforementioned rule would be justified. You simply cannot (at least under any circumstance I can think of) say, for the safety of the citizens, I am going to fire without knowing what I am going to strike, or who's behind my target that could be injured, in order to safe lives. So you're disregarding the safety of people youself....in order to keep people safe ?

Let's hope most cops don't subscribe to this theory. It's "the ends justify the means" type of thing. In order to get the bad guy....we'll shoot to kill the bad guy without regard for whoever else is in the area (or behind the criminal) and may be injured.

All this craziness yesterday over the Empire State shootings and it appears it was the NYPD doing all the shooting. Mayor Bloomberg should stop worrying about gun control across the country and worry about his own back yard.

Unfortunately the Dems are probably celebrating as this is a major black eye for police commissioner Ray Kelly who many were trying to persuade to run for the GOP mayoral seat.
All I can say is, Thank God they got hit by friendly fire and not bullets from the killer's gun. I am sure they are comforted greatly.

With all the money they spend on law enforcement, you woud think they would teach the cops to pick a target and shoot straight before they turn them loose on the street wth loaded firearms. Where is Barney Fife when you need him?

I've noted this a couple times but the site can always use more post count.

How do you know whether or not the bullets missed their target?

Hopefully 3 civilians with full bullets in them were NOT targeted.
