Based on what? There's no basis for a legal claim when neither the state nor the federal government lists sexual orientation as a protected class.
I guess you don't understand that someone can sue for anything. States that once said gay marriage was illegal were sued until the case reached the Supreme Court and the court ruled in favor of gay marriage. That is how our country functions in case you didn't know that.

You are speculating, Student A could have easily said that they do in fact have a penis without showing it to people. Do you have to show your vagina to prove that you have one? Of course not.
