There is a double standard.
The county clerk doesn't perform marriage ceremonies at all, it's not part of her job, Issuing licenses is part of her job, and she can not refuse to issue them, plus she is the ONLY county clerk in Rowan county hers is the only office in the county to get marriage licenses, so who did she refer them to?

The bakers violated state LAW. The judges aren't.

County clerk: required to issue licenses to all who qualify. Kim didn't. Perfectly illegal.

Some judges are required to perform marriages, some aren't, BTW. If this judge were required to perform marriages then her options would be the same as Kim ... do it or resign.

Yes this judge has her reasons ... and is making a statement. But again, it's legal and it is not an abrogation of duty or oath. It's not even discrimination ... in fact she's AVOIDING discrimination by not marrying just heterosexuals.

In one of the states - can't remember if it was NC or TN - that is trying to find a way to accommodate the marriage laws and the religious objections of local officials this was considered a fundamental difference. Under their present system a country clerk had to authorize a marriage license, whereas a judge is not required to marry people, though legally able to do it. It is an optional part of their official job.

The conclusion seemed to be that as judges were not required in order have a marriage that the state would only deal with how to iron out the problem with county clerks whose issuing of a license is a legal necessity.

Makes sense.

I am thinking of becoming a wedding officiant. (true) sigh..

I will refuse to marry men, and the family pets. We all know it is just a matter of time before it is legal, and I will be asked.

I do not know what I will do if I have to bake the cake. It will be a real nightmare (pronounced nightmaya).

I may face all sorts of mockery and derision, especially from the Texas peanut gallery where it all began.

I hope Uncle Sugar visits me in jail, with Ted Cruz for a photo-op. They have to bring cookies though....oh, and brownies. Love me some brownies.
