If your tint fails and you elect to pay the fine rather than removing the tint, can you still be ticketed for illegal tint if you're pulled over? Or would the LEO be able to check the database and see that you paid the fine and then let you off?
There are no waivers, it's pass or fail. You can get a medical waiver that a docror issues for light sensitivity issues. I've only ever seen one, and the guy still failed because his tint was darker than the waiver stated. Tint is easy to remove, a razor blade and soapy water works well. Rear windows pose an issue if it has exposed heating elements for the defroster. Waivers are only applicable to emmisions related repairs, and even then you must spend the required amount of $$$ before you can get one.
i failed on 2 things cracked turn signal lens and parking brake not working i have fixed the light problem can it be passed on that parking brake issue so that i may renew tag and get the parking brake fixed later?

No. It has to pass everything before tag can be renewed.
